 Shade Space Sail Fit Warranty Terms and Conditions

  1. Overview of the Shade Sail Fit Warranty

1.1. The Shade Space Sail Fit Warranty ("Warranty") applies exclusively to shade sails ("Sail(s)") purchased through the Shade Space website using our 3D Shade Sail Design Shade Sail Verifier with the integrated Measurement Verifying Program ("Shade Sail Verifier").

1.2. Under this Warranty, Shade Space guarantees that the Sail will fit the structure for which it was ordered, provided that the customer ("Customer") has accurately entered all required measurements into the Shade Sail Verifier.

1.3. If the Sail does not fit the structure despite the accurate use of the Shade Sail Verifier, Shade Space will replace the Sail free of charge, subject to the terms and conditions set forth herein.

  1. Eligibility

2.1. To qualify for the Warranty, the Customer must:

  1. Use the Shade Sail Verifier to design and order the Sail from Shade Space.
  2. Enter all measurements accurately into the Shade Sail Verifier as required by the Shade Sail Verifier's instructions.
  3. Ensure that the structure for which the Sail is intended is built or prepared in accordance with the specifications used when entering measurements into the Shade Sail Verifier.

 

2.2. The Warranty applies only to custom-sized Sails ordered via the Shade Space website.

2.3. The Warranty does not apply to:

  1. Sails not ordered using the Shade Sail Verifier.
  2. Standard-sized, ready-made Sails.
  3. Sails that do not fit due to inaccuracies in the measurements entered by the Customer.
  4. Sails that do not fit due to changes made to the structure after the order was placed.
  5. Claim Process

3.1. If the Customer believes that the Sail does not fit the structure despite accurate use of the Shade Sail Verifier, the Customer must:

  1. Notify Shade Space in writing within 14 days of discovering the issue.
  2. Provide photographs and other documentation as requested by Shade Space to verify the fit issue.

3.2. Upon receiving a claim, Shade Space will review the measurements, the documentation provided by the Customer, and the original order details.

3.3. If Shade Space determines that the Sail does not fit due to a failure of the Shade Sail Verifier or an error on our part, Shade Space will, at our discretion: a. Replace the Sail free of charge; or b. Provide a refund for the Sail.

  1. Limitations and Exclusions

4.1. The Warranty does not cover:

  1. Incorrect measurements provided by the Customer.
  2. Sails that do not fit due to structural modifications made after the measurements were taken.
  3. Damage to the Sail caused by improper installation, misuse, or environmental factors.

 

4.2. The Warranty is void if the Customer fails to follow the Shade Sail Verifier’s measurement instructions or if the structure is not built to the specifications assumed when the measurements were entered.

4.3. The Warranty is limited to the replacement or refund of the Sail as described in Section 3.3 and does not cover any associated costs, including but not limited to shipping, installation, or labor costs.

  1. Governing Law

5.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand.

  1. Amendments

6.1. Shade Space reserves the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the Shade Space website.

  1. Acceptance of Terms

7.1. By ordering a Sail using the Shade Sail Verifier, the Customer agrees to be bound by these Terms and Conditions.

Workmanship Warranty

 Shade Space (“The Supplier”) warrants the integrity of the workmanship of your shade sail (“the product”) and will remedy any defects arising from workmanship or materials used in the manufacture of the product on the basis of the conditions set out in the conditions of warranty below.

  1. This workmanship warranty is e­ffective as per the warranty specified for the particular fabric used in the manufacture of the completed shade product. See separate fabric warranty
  2. This warranty is void if the product has been subject to mistreatment, alteration or vandalism, if the product has been used for a purpose other than it has been designed for, or the product has been damaged by extreme weather conditions or an act of God. Any damage caused by improper installation (including, but not limited to poor design, engineering, permitting, support construction, faulty materials, over or under tensioning the shade sail etc) is specifically excluded from any warranty claim.
  3. This warranty is void if the product has not been properly cared for or maintained. See care instructions for the specific fabric used in the product.
  4. This warranty does not cover colour fading due to exposure to ultra-violet rays, damage to the shade sail due to exposure to chemicals or placement near open flame.
  5. Please note that with many shade products, joins or seams are necessary due to available fabric widths. There can also be slight colour variations through the fabric rolls due to the knitting or coating process. Our manufacturers are trained to minimise seams and avoid major colour variations; however, some seams and colour variations are inevitable and will be visible. This is quite normal, should be expected and is not covered by this warranty.
  6. The warranty excludes alterations or repairs if incorrect measurements were supplied to Shade Space
  7. We do take extra care to package all shade products, however the warranty does not cover any product damage during transit with a freight company. This is the freight companies’ responsibility should any damage occur, please check the product upon arrival.
  8. Once installed correctly, it is the Customers responsibility to check the tension of the shade sail or organise for it to be checked by a professional. It is normal for a shade sail to require re-tensioning annually. This warranty does not cover any gradual sagging.
  9. The Supplier’s maximum liability to you under this warranty is limited to an amount not exceeding the invoiced value of the work. Some fabric manufacturers warranties have a reducing pro rata warranty and that will apply to the workmanship. The Supplier shall not be liable to you for any indirect or consequential loss or damage of any kind out of any warranty claim.
  10. If you discover a defect in the shade sail during the warranty period and wish to obtain a replacement or repair, please contact the Installer and provide photographic evidence of the defect within 90 days along with a written description of the claimed defect. Shade Space shall determine if the warranty applies, and shall then, at their discretion, either repair or replace the product
